Image ownership question?

Hello,

I was a participant in the South Texas Music Awards. I also took images at the event of some big name musicians in the Tejano genre. My question is; Do I have to get releases to sell these images? Do I have to get their permission to submit them into our local camera club annual show? What can I do with these images? There was no admission charge to this event, but you did have to win tickets from the radio station that sponsored the event. Public performance and fair game?

When you photography public figures you can usually use them for any kind of news reporting and for display in a portfolio or club event, etc. But if you tried to use the image for commercial purposes, then you would need a release.

If you did not have a ticket you probably are well within your rights to use the shots as "newsworthy" use of public figures in public places. When you have to purchase a ticket many times in the fine print it will state that photographs are the property of the venue, team, or performer. Most times - as you probably know - unless you are invited to photograph a performer security will tell you no cameras are allowed into the venue period. You might want to check out the information from a local attorney here in Atlanta who specializes in just such questions. When I am covering an event for a publication as a freelance sub contractor, and get paid by the publication for my work, I can still turn around and sell the pictures I take to people interested in buying them, and do all the time.

In all my years of shooting for publications, I have never had the need to get a signed release of every identifiable person in the photo.

I have however delt with idiots who walk up to me and say some B.S. about getting "royalties" out of this.. My usual reply is to tell them to go pound sand.
