I received a phone call from a model asking my rates, a little further into the discussion, she informed me that her "Agency" would have full rights to the images and I would need to sign a release of copyright contract, she's sending me the contract via email tomorrow, I guess my question is, what to charge for such a shoot, I informed her that the price just went way up,because of the release. I have no clue as to what to charge for releasing images and copyrights. Suggestions???



(Not the model in question, Just a recent image of Lexi!!)

Treat it like a commercial work for hire deal... I charge my rate and the client gets the images to do with what they want. They own the copyrights as well. If they want me to retouch the images they pay an additional fee for that....

Why sign away rights? Just negotiate a long term license. Most clients won't want the photos for more than a few years anyway, and you can license for as many different uses as they need.

I'm not sure this is relevant, but an old advisor of mine once remarked that he was going to be away on a consulting job - although it was well-known that he hated consulting. I asked him how he ever decided that it was worth doing - and he replied, "I figure out just how much it's worth to me to do a task I hate, then I ask for twice that amount. If they pay, I'll do it."
This would be a job where you won't make anything on future sales/use of the images - so get all the money you'd expect for those future sales up front. And, IMO, some for the aggravation of the situation.

Don, just my opinion but I would avoid this situation like the plague. What the model didn't tell you (maybe she doesn't know, maybe she, or her agency, is trying to get away with something) is that this is Work For Hire and unless you are careful you get royally screwed. If you agree to this you have absolutely no rights whatsoever to any of your photos ever. If this girl turns out to be the next "it" girl you get nothing.

If you are going to photograph her make sure you are well compensated and that you get your money the day of the shoot.

Statistically what is the probability that this girl from Kansas will be the next girl. Very unlikely with how the economy is in the toilet and no one is paying much of anything. How many girls are trying to be the it girl and how many girls actually get to be that it girl.

For us guys it was like high school football. Everyone got to get on the team. In college it became more selective and 1/10 of every high school foot ball player got on. Then in the NFL 1/100 of collegiate football players play football to the NFL.

The glory days of models in NYC is pretty much to the way side. She has really stiff competition. INHO make the shoot worth your time so you can maybe buy more gear. We all want or need more gear.

No problem at all. If a client wants me to assign copyright to them, that's fine with me, I'm always glad to do it. Just take your normal rate and multiply it by 3 or 5. Do the shoot, give them a CD, then go to the bank.
