Is legal to do both or act as both Photographer and Agent or Studio and Agency - what makes it different from the scams that you hear of?
I'm totally unclear on this. What is okay and what is not okay.
For example:Photographer gets paid by Model for a Photo session, can he act on her behalf as an agent (with her permission or by her request)- send the Photos to say Playboy or what ever, if she gets the gig - take a percentage as acting agent?
Also for this example lets say all liscenses are in order for both Photog Studio and Agency... if possible. (I don't know i haven't checked into it that thoroughly.)
I can see the benitfits to both Photog and Model if this is possible legal etc.
I've seen many losses for those Photogs that do not act as agent or get a percentage of a gig if the Model gets the job he submited her for or told her about.
ie: Photographer gets paid say $300 bucks for the shoot for example
- Photog has the connections or the know how takes the initive, sends in the Models photos for submition and consideration on the Models behalf - Model gets the gig - she's paid $25,000 let say. Photog gets nothing!
which with-out the photog, the gig for the Model may or may not ever come to be.
To me it seems a great match - Photog/Agent as one. But then, you read about the scams and it seems that if the two are joined, Photog studio/Agency - it's considered a scam...
god forbid you tell the talent they look good, build their confidence, (which they will need due to many regections) - want to charge for a photoshoot or re-prints or comp-cards or if she totally sucks that day or wasn't the right look for the gig and didn't get the job on a casting call she was sent on. Then it must be a scam because the Photog Studio and Agency are one. Or Photog is acting as Agent as well.
Currently, I'm not A Pro - I don't own a studio I'm not an agent or acting as one - but I would like this cleared up for my own knowledge.
edit: Whiile on this subject if you wouldn't mind could you clarify:
Is there a differnce between a Model Management company like Fords and Elite that have their own Photo studios and Photographers and a Agency/Photography Studio or Agent/Photographer or Photographer/Agent etc.?
As well, one final related question - If it is okay to combine a Photography Studio and Agency why aren't more Photographers or Agents doing so? If it's not okay to combine them - why?
