Minor in a swimsuit calendar?

As I mentioned before I am producing a unusual swimsuit calendar. I've been taking applications and I got one recently from a model under 18. Actually she'll be 17 in July.

She's got the look for the calendar. She looks good in a swimsuit. She's willing to come down and shoot and will bring a guardian.

But the question is should I use her? I've been told its crazy. Told that I shouldn't use her in a calendar from a business POV because a swimsuit calendar is intentional "visual titillation".

And I've been told there's nothing illegal about it. She's in a swimsuit, not naked or implied. And that they use minor models all the time in fashion modeling work.

Is this one of those "If you have to ask.." questions?

I'd really like some advice, particularly from people who've done this kind of calendar before.

IMHO, it only takes one self-righteous "Think of the children" zealot to open you up to a whole bunch of the kind of publicity that you don't want.

Sadly, the way things seem to work these days is if one person decides to kick up a stink, the media will pen you as a lecherous purveyor of child porn by the end of the day regardless of whether it was legal and done with the parents consent.

You probably COULD use her and have no problems, but why? If it were me, I'd only use her as an absolute last resort. As in, the project won't be completed without using her. Unless there's more to the story than we're reading here, I see no reason to use an under age model. There are plenty of "of age" models you could use. Just my two cents.

She fits the particular slant of this calendar (goth) that does cause me to have problems finding models.

I'd have to agree with the previous opinions. You'd be using a minor in a titillating way. You'd be playing with fire.

Maybe I'm too old, but I don't see the problem here. We are getting to the point were if a sign says we don't serve people with bare feet we think we'll not get served if we are wearing sandals. When they stop selling swim suits to people under 18, then we should stop taking photos of them.. YMMV

I would also agree with the majority of the posts ... don't use her. It only takes one person to call the media and it will ruin your reputation (just look at that Lacross team). You mentioned that it's a "Goth" calendar. I would bet that there are plenty of 18+ models that "could" pull off the goth look with a good MUA or tips from one of your other Goth models. In fact, I imagine you could find several professional models that would LOVE to try a Goth look, just for fun of it.

Finally, if you like her SO much, book her now to do next year's calendar ... when she's 18.
