might be spelled out in black and white but the real issue is can the individual AFFORD to defend them.
If we fight an individual or organization we might win a settlement. But fighting a government even when we are right might cost millions and there is no recourse. You can't sue the government without their permission.
The truth is, lawyers cost lots of money, courts cost lots of money, defending one's self cost lots of money. But the loss of mere wealth is not the end of it. What about the psychological and emotional damage to self, family and business. Will your business survive? Will your family come through unscathed? And what about you, how do you keep from curling up in a corner with a loaded gun? How many factor those costs into the bottom line?

...and of COURSE you can sue a government entity without permission! Have you not read the Bill Of Rights lately? The first amendment CLEARLY states, "Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances."

Simply put, photographers should know and exercise their rights to persue their art (see the First Amendment again).

The point is look before you leap. Is the consequences worth the fight. Do you TRULY understand the depth and the length of the pool?

Ever tried? Ever been mauled by the justice system. Ever been accused of criminal activity and even though innocent see the looks on faces of friends and family. Ever see a struggling business, or a thriving one for that matter, dry up? Ever look in the mirror for twenty years and wonder what the hell happened and why? Some times bending over and taking it is the easy part.

It's easy to posture. . . just make sure the posture isn't that of the mouse with middle finger extended just before the eagle gets him.
