I want to do some shoots with the focus on a product with the help of a beautiful model . Do I need to get a release from them or what ? I don't plan on making any money from this venture just doing it for fun.

Rework their logo to read, Cola vs. Coke. That way you're not actually borrowing a copywrited icon . . . just creating a look-alike.

Simple.

Be careful, Coca Cola has everything about themselves tradmark or copyright protected and they have a whole room full of lawyers searching for something to do. Seriousy, I was by a friend who used to do design work in their ads that they even have 'their' color of red protected as part of their logo. They are probably the most protective of the stuff than any other corporation.

Sure. You can set up and shoot any product for practice, however you like.

You just can't show those shots to anyone without a certain degree of risk.

Ever.

If you want shots to show, for example, to prospective clients, then you've got to be concerned with copyright issues. You'd probably be best to use containers from "generic" store brands, possibly even removing those labels. While that's probably extreme, but it is safe.

Logically (but not necessarily legally), you should be able to use any image in an artistic creation, and it's my understanding that the courts tend to favor the artistists in such issues. However, you've got to ask whether what you're doing is clearly "art" with no commercial aspect. Why not use food and produce shots, or wine in glass, or (costume) jewelry, etc., if you're concerned with these issues.

Take a gander at a magazine called PHOTOSHOP USER at your local news stand and notice the lengths to which they go to replicate ads of well known products and obscure the particular brand's identity.

As was said before... you can shoot the original products in their original form all you want. You just better not show them publicly, ever.

An acquaintance got a 'cease and desist' demand for something similar one time ( a parody that was very thinly disguised)... cost him a fair amount of money (a few hundred dollars for a lawyer) to comply and prove to the original corporation that he was complying. The lawyer told him that the corporation was letting him off exceedingly lightly...

If this idea was to try your hand at product photography, why not save yourself the legal grief, get creative with the idea and create a "product" of your own, say "That Look Lipstick", or "That Look Cola", make up a cool little label, slap it on a clear bottle and away you go! Same result, no hassle. I think that would be better than scrapping the idea. Heck, if you don't mind, I might try something like that myself [img]/ubbthreads/images/graemlins/laugh.gif[/img]!
