Predicament.

I recently found myself in a odd situation and am curious as to what some of you other photogs would do if this situtation arose.

I had a model I shot 2 years ago and didn't sell as many images as I had hoped to and lost money on the shoot. Fast forward 2 years and I decided to go through a old batch of slides and do a resubmit. This time, making enough from the submission to get my head above water from the shoot and my output of $$. Only problem is that now the model no longer wishes to be in that publication.

Do you:
A) Say f it and sell the pics anyway
B) Offer the model a buyout, and burn the slides
C) Don't sell them to the mag or her and just cut your loses

I don't think A is an option at all. I think the "repurcussions" could be greater than your lost as it is now. If she took it to a higher level you may win, BUT it costs to defend yourself (in an extereme case scenario)

I personally would push B very hard, especially if you have the proper release...then YOU have the leverage...

And finally, a lot depends on the amount of money you are at risk. If its a small amount, then why risk the unknown...If we are talking large monies then obviously you need to try and get some return on the initial investment...

Anf if it's really, REALLY BIG money,,,,then its A all the way [img]/ubbthreads/images/graemlins/grin.gif[/img](jk)

Try B first, then proceed to C (do not pass Go, do not collect $200). [img]/ubbthreads/images/graemlins/grin.gif[/img]
I something like this happen once when the model got married an no longer wanted glamour type photos hanging out there out of her control. She agreed to reimburse me for the fee she had been paid and the film and processing costs. So I broke even, and had no problems.

Who has the rights to the images?

If you have a release then it's your decision. I WOULD NOT OFFER TO SELL THEM TO HER, lest ye be called a blackmailer. If you want to do this, get your lawyer to make her the offer, and I think I'd only do it then if I had an offer to buy them in writing from someone else..

Sell them.

A. that's what you shot them for right?

B. I'm sure you have a proper release, right?

C. You own the copyright, right?

D. You get published in the process?

E. You get paid.

F. You teach "wannabe" models not to pose for photos thinkin they can just change their minds and change a
business transaction. Which might actually limit the number
of models, which might actually be good for the modeling industry and the photographers.

Those who work get paid, get published, and everybody would be happy.

What are you going to do next? Give her the slides.

Do what you want, but I hope I never see a post from you about how "professional" you are.

There's no predicament.

Why would you stop to consider the feelings of a model 2 years down the road who is being unprofessional by not wanting "her photos" out. They aren't "her photos", they are yours.

Anybody who would advise you to choose anything but selling them, needs to rethink their business.

If you bought a car and 2 years later the dealer wanted you to bring it back, would you? Would there be a predicament?

What exactly is the predicament. That you might hurt her feelings? What?

Please explain the predicament to me.

Are you worried about your reputation. What exactly is your reputation.....that of one who gets walked all over by amateur models?
